The Amazon Web Services materials available at compliance.salesforce.com ("AWS Confidential Information") are confidential information of AWS and its affiliates (collectively, "AWS") and are subject to the below terms, which are applicable to your access to, and use of, the AWS Confidential Information. These terms constitute a legally binding agreement ("Agreement"). Please read them carefully. By accessing or viewing the AWS Confidential Information, you agree to these terms on your behalf and on behalf of the entity with which you are employed (your “Company”). You represent that you have the authority to agree to these terms on your Company’s behalf. If you do not have such authority and/or are not willing to be bound by these terms, you may not view or access the AWS Confidential Information. The AWS Confidential Information is the confidential information and trade secrets of AWS. You will use the same degree of care to protect the confidentiality and trade secret status of the AWS Confidential Information as you do to protect your own confidential information of like kind (but not less than reasonable care). You will not use the AWS Confidential Information for any purpose other than to evaluate AWS’s services for use by your Company or its affiliates (the “Purpose”). You will limit access to the AWS Confidential Information only to those employed by your Company (or your Company’s affiliates) who need that access for the Purpose and who have executed confidentiality agreements with your Company or its affiliates containing protections not materially less protective than those in these terms. You will not disclose AWS Confidential Information to any third party other than your Company’s affiliates without AWS’s prior written consent and your Company will remain responsible for compliance with this paragraph by your Company’s affiliates. You may disclose the AWS Confidential Information to the extent compelled by law to do so, provided you give AWS prior notice of the compelled disclosure (to the extent legally permitted) and reasonable assistance, at AWS’s cost, if AWS wishes to contest the disclosure. AWS Confidential Information does not include any information that: (i) is or becomes generally known to the public without breach of any obligation owed to AWS, (ii) was known to you prior to its disclosure by AWS without breach of any obligation owed to AWS, (iii) is received from a third party without breach of any obligation owed to AWS, or (iv) was independently developed by you. AWS is an intended beneficiary of this Agreement and is entitled to enforce its rights hereunder as if it were a party to this Agreement.
